La revisión penal por razón de la amnistía (un examen de la regulación contenida en la proposición de Ley Orgánica de amnistía para la normalización institucional, política y social en Cataluña)

Abstract

This article is framed in the regulation contained in the Proposition of Organic Law of Amnesty for the institutional, political and social normalization in Catalonia, presented last November 13, 2023 by the Socialist Parliamentary Group and which is currently being processed in the Congress. In particular, after a brief reminder of the characteristics of the amnesty in comparison with the indult and the analysis of the form in which it is regulated in the mentioned Proposition, the revision of final criminal sentences for the application of the amnesty is analyzed, with a detailed study of its general configuration, its object, the type of motive that comprises it, the competence and the procedure to declare it and the effects of the sentence that resolves on it.
