Abstract

The transition from a linear economy to a circular one needs a systemic change at all levels. Although there are many advances in different areas, the requirements of this new model have not fully permeated the tourism sector, which is define as priority by Spanish Circular Economy Strategy. Refusing to take mandatory measures, in this sector still prevail the voluntary ones, mainly based on self-regulation systems which transfer the responsibility for this complex transformation to private subjects. Nevertheless, in order to fulfil the desire of a circular economy, there is an urgent need for the definitive leap from a model based on voluntariness to one characterized by the existence of legally enforceable measures. The aim of this paper is to identify the techniques provided in the legal system that allow progress towards the circularization of the tourism sector, systematise them and, if applicable, suggest proposals for the improvement of the regulation in force.
