Résumé

The Organic Law for the regulation of euthanasia (LORE) has fully entered into force in mid-2021 and all the data indicates that it is being applied in a barely problematic way. This paper studies the design of the LORE, pointing out some deficiencies, among which its very name stands out, as well as the absence of a clear configuration of the nature of the right to end one’s own life, which has a foundation that exceeds the fundamental right to the life of article 15 EC. The nature and meaning of the Guarantee and Evaluation Commission established by the Law is pointed out and attention is drawn to the need for a profound review of the legal regime of the medical certification of death, whose deficiencies have been indirectly highlighted by the entry into force of the LORE.
