Laburpena

The one who is silent says nothing or any manifest will. Therefore, whoever remains silent in the face of a certain contractual proposal made to the contrary, a priori, does not accept that proposal. However, based on the fact that acceptance does not always have to be express, jurisprudence has developed and consolidated a doctrine that, with due caution, interpreting and evaluating the specific case and always under certain circumstances, assumptions and conditions, to that silence of one party can be attributed a declaration of willingness to accept the other party‘s proposal. This work analyzes and comments on this doctrine: its foundation, requirements and certain particularities in cases such as the waiver of rights
