Résumé

The presentation of the Global Strategy on Foreign and Segurity Policiy for the European Union to the European Council inJune 2016 has, among other things, highlighted the will of the Union to acquire a certain ‘strategic autonomy’ that allows it to act as a warrant of collective sucurity in Europe. The terrorist attacks perpetrated by Daesh during 2015 and 2016 in France, Belgium and Germany have convinced the Member States of the European Union of the need to tackle their respective threats together by resorting, if necessary, to the instruments provided with the Lisbon Treaty, namely the mutual assistance clause and/or the solidarity clause. With the theoretical framework of the Global Strategy as a reference, and taking into account the practical experience from the Paris attacks, this contribution aims to conduct a detailed examination of the legal and political terms in which the use by France of the mutual assistance clause has materialized in the context of its response to the said attacks. This will lay the ground for a clarification of some of the legal and political questions that have emerged and are worth considering in the light of the principles and values set out in the EU Global Strategy itself.
